A New York company has sued several Delaware County-based firms in Pennsylvania, alleging breach of contract.
Robert James Sales Inc. (RJS) of Cheektowaga, New York, sued Roberts Filter Holding Company, Roberts Filter Group, Roberts Industries and Roberts Water Technologies, based in Media and Darby, Pennsylvania, in U.S. District Court Eastern District of Pennsylvania on May 22, alleging a defaulted payment for goods in February 2015.
The plaintiff sells stainless-steel piping, valves and fittings to the process-piping industry. The lawsuit said the defendants provide water treatment, purification, and wastewater-management equipment and services.
The filing indicates that the defendants placed a purchase order with RJS on or about Oct. 1, 2014. Terms called for two separate shipments during October, with staggered payments. The complaint said RJS sent the second shipment on or about Jan. 7, 2015. The suit said partial payment was made for the first half of the delivery, but the balance due on Feb. 7, 2015, has not been paid, as per the agreement.
Alleging that the defendant owes $187,223.25, the plaintiff cites breach of contract and good faith, violation of state law and the Uniform Commercial Code, and unjust enrichment. RJS requests compensatory, incidental and punitive damages; lost profits; pre- and post-judgment interest; attorneys’ fees; and other court costs.
