Bicycle crash spurs liability suit

A Philadelphia man is suing the Pennsylvania Department of Transportation for injuries he suffered after falling off his bicycle at a depressed section of roadway.

A premises liability lawsuit filed with the Philadelphia Court of Common Pleas by Philadelphia-based attorney Justin Bieber May 4 alleges that William Tsichlis, of the city’s Port Richmond section, was riding his bike in the area of Richmond Street and Girard Avenue when he encountered a large divot in the road.

The third party liability claim alleges that the negligence on the part of PennDOT to not maintain the roadway caused Tsichlis’ spill.

In the lawsuit, the plaintiff said he suffered injuries including fracture of the clavicle, necessitating surgical repair; contusion and laceration of the knee; and injuries to one of his ribs.

The incident has caused, and will cause, the plaintiff to undergo medical attention and care and experience a loss of earnings and earning power and capacity, the complaint states.

The plaintiff in this case is seeking damages in excess of the arbitration limits, which is set at no less than $50,000, as well as interest and court costs.

The plaintiff requested a jury trial; the case is awaiting listing.
