A Philadelphia woman is suing a handful of corporate property owners in Center City for injuries she allegedly sustained after falling on a portion of the sidewalk controlled by the defendants.
Attorney David Sherman, of the downtown Philadelphia firm Solomon, Sherman & Gabay, filed the premises liability lawsuit May 10 in the Philadelphia Court of Common Pleas.
Named as defendants are Philadelphia Health & Education Corporation, Hahnemann University Hospital, Tenet Health System Philadelphia Inc. and Tenet Health System Hahnemann LLC.
The complaint states that in early June 2009, plaintiff Cynthia Moore was walking along the sidewalk in front of a building at 219-225 North Broad St. when she tripped and fell as a result of a “dangerous and defective hole, grate or/and depression on the sidewalk.”
The incident was a direct result of the defendants’ negligence, carelessness and recklessness, which included failing to inspect the area, cure the defect, monitor and/or cordon off the area, according to the lawsuit.
The fall caused Moore to suffer injuries to her right foot and surrounding body parts, including a “fracture of the right metatarsal, pain in limb, tenosynovitis of the right foot and ankle, and other injuries,” the complaint states.
The injuries have caused the plaintiff to incur medical and other expenses related to her ongoing treatment, the suit states. The accident may have also aggravated pre-existing conditions.
Moore has also been unable to attend to her daily duties and has suffered a loss of life’s pleasures because of her physical condition, the suit claims.
Furthermore, Moore’s medical bills have exceeded $1,500, and she has sustained “a permanent and substantial impairment of a bodily function,” the suit claims.
Moore is seeking a judgment against the defendants in excess of $50,000.
The non-jury trial is set for an arbitration hearing Jan. 11, 2012.
