City sued for slip-and-fall incident

A Philadelphia woman is suing the City of Philadelphia and the Pennsylvania Department of Transportation for injuries she allegedly sustained after falling at a crosswalk at the intersection of 60th and Trinity streets.

Attorney Bentley Saul of Bentley M. Saul LTD filed the premises liability lawsuit May 11 in the Philadelphia Court of Common Pleas on behalf of Yvonne Harris.

In the complaint, Harris alleges that she sustained “serious permanent disabling and life-altering bodily injuries” after her right foot and ankle twisted as a direct result of the fall, which occurred in a spot with eroded and uneven blacktop with a hole in it.

The lawsuit claims that the defendants had advanced knowledge of the street’s condition, but did nothing to correct it, which created a hazard for the public.

The complaint states that the plaintiff’s claims fall within exceptions to any applicable governmental immunity provisions and laws, since the defendants are government agencies.

The fall left Harris with injuries to her foot and ankle including damage to the bones, tissues and tendons, according to the suit.

Harris is seeking damages from the defendants jointly and/or severally in an amount in excess of the arbitration limits, which is $50,000, plus other sums deemed appropriate by the court.

The case is a non-jury matter.
