Buckley construction named in product liability suit

A Springfield, Pa. man is suing a Philadelphia construction company for injur

ies he sustained after falling out of a hydraulic lift lent to him by the contracting firm.

The product liability lawsuit was filed jointly by Philadelphia attorneys James D. Golkow and Ramon Arreola, of Golkow Hessel, LLC, on behalf of Mike E. Zoidis and his spouse, Callie.

The defendants in the case are Buckley & Co. Inc., Buckley & Sons, Buckley & Associates L.P., and GAR Equipment Corp.

According to the civil complaint, Mike Zoidis was working at the time for M.C. Painting Corp., which was hired to repaint the University City Bridge in Philadelphia.

In early Aug. 2009, Zoidis was situated inside the lift owned by Buckley when the basket broke away from the hydraulic arm of the lift causing serious injuries to the plaintiff, the suit states.

The lawsuit faults Buckley, which owns the lift, and GAR, which distributes the device, for failing to ensure the piece of equipment was safe for use by contractors.

As a result of the accident, Zoidis sustained numerous physical injuries, such as back spasms and disc herniations, as well as a partial elbow ligament tear, the suit states.

All of the plaintiff’s injuries are permanent in nature, and required medical attention, thereby leading Zoidis to expend vast sums of money, the suit claims.

In the lawsuit, the plaintiff is also claiming he suffered embarrassment, humiliation and other emotional issues as a result of the incident.

The suit accuses the defendants of carelessness and recklessness.

For each of the seven counts in the lawsuit, the plaintiff is seeking damages against the defendants in an amount in excess of $50,000, together with attorney’s fees and other related court costs.

The lawsuit additionally contains a loss of consortium count, in which the plaintiff’s wife, Callie Zoidis, claims to have been robbed of her husband’s companionship. Callie Zoidis also seeks judgment in an amount in excess of $50,000 plus related costs.

The plaintiffs have requested a jury trial.
