Apartment fight leads to assault and battery lawsuit

A Philadelphia man is suing a Baltimore, Md. man over injuries the plaintiff alleges he sustained after the defendant struck him in the face during a dispute.

Philadelphia attorney Paul H. Masciantonio filed the assault and battery lawsuit June 3 at the Philadelphia Court of Common Pleas on behalf of client Anas Shraim.

In the complaint, Shraim alleges that the defendant, Patrick Reed Mahoney,
punched him in the face while Shraim was visiting the apartment of a friend on Lancaster Avenue in Philadelphia.

The lawsuit says that on that day back in mid January of this year, “defendant Patrick Reed Mahoney did violently break into the premises and without provocation assaulted and battered plaintiff.”

The complaint says the defendant struck the plaintiff in the face with his fist, which caused Shraim to require six stitches to close the wound. Shraim also sustained a concussion, contusions to the head, lacerations, sprain and strain, “and various other ills and injuries, the full extent of which are presently unknown.”

The lawsuit states that Shraim also suffered a shock to his nervous system, humiliation, inconvenience, embarrassment, anxiety, mental anguish, extreme pain and suffering and other injuries.

Shraim was required to undergo medical treatment, surgery and additional medical care due to the incident, the suit states, which has caused him to expend various sums of money. The plaintiff also has suffered lost wages because he has been unable to work and attend to his daily duties.

The lawsuit contains three separate counts: assault and battery, intentional infliction of emotional distress and negligent infliction of emotional distress.

For each of the three counts listed, Shraim seeks judgments against the defendant in an amount not in excess of $50,000, plus punitive damages, court costs and interest.

The non-jury matter is scheduled for an arbitration hearing on Feb. 6, 2012.
