A Northeast Philadelphia man who slipped and fell on a puddle of water on the floor of a city supermarket is suing the business for injuries he sustained as a result of the accident.
Philadelphia attorney Timothy R. Hough, of the firm Jaffe & Hough, filed the premises liability lawsuit July 8 at the Philadelphia Court of Common Pleas on behalf of Charles Hood.
The defendants named in the complaint are Holiday Supermarkets, Inc., and Stop and Shop Markets, Inc.
According to the complaint, Hood was shopping at the Holiday Thriftway, located at Frankford and Pratt streets in Philadelphia, on Aug. 20, 2009, when he slipped and fell on a wet floor.
As a result of the accident, Hood sustained injuries to his neck, head, shoulder, back, hips and knee, the suit states. Hood also suffered vision problems as a result of his fall.
The lawsuit accuses the defendants of negligence for allowing a large quantity of water, approximately 18 by 24 feet wide by three feet long, to accumulate and remain on the floor. It also faults the defendants for failing to take the proper steps to ensure that members of the public would be made aware of the defective condition.
As a result of the incident, Hood sustained “emotional upset and worry,” sustained a loss of life’s pleasures, suffered humiliation and embarrassment, and sustained a “positive loss of the sense of well being,” the lawsuit states.
Hood also has had to expend various sums of money on medical treatment.
Hood requests judgment in his fair in an amount not in excess of $50,000.
The non-jury matter has been scheduled for arbitration.
