Wheelchair ramp incident leads to personal injury claim

A handicapped woman who claims she suffered physical injuries after an employee of a transportation service negligently placed her on a van wheelchair ramp is suing the organization.

Philadelphia attorney Leonard K. Hill, of Hill & Associates, filed the personal injury lawsuit July 20 at the Philadelphia Court of Common Pleas on behalf of Ines Rivera.

Named as defendants in the lawsuit are Atlanta, GA-based LogistiCare Solutions, LLC, and Philadelphia-based Art of Life, Inc., as well as Philadelphia resident Kevin Joe, an employee with Art of Life.

According to the complaint, Rivera was improperly placed on a wheelchair ramp leading to a van by defendant Joe on Dec. 17, 2009. The incident caused Rivera to have to undergo the amputation of her extremity and other personal injuries, “which have caused and will continue to cause her a great deal of embarrassment, humiliation, pain, suffering, agony, inconvenience, and which may be permanent in nature and character,” according to the lawsuit.

Because of her injuries, Rivera has been caused to expend various sums of money on medicine and medical treatment, the suit states. She also claims to have been prevented from carrying out her usual duties, activities and occupations.

According to her complaint, both Art of Life and LogistiCare Solutions were responsible for transporting Rivera at the time of her accident.

The lawsuit accuses all of the defendants of negligence for failing to properly maneuver the plaintiff.

Rivera demands judgment against the defendants in a sum in excess of $50,000.

A jury trial has been demanded.
