Oklahoma man files denture adhesive cream lawsuit in Philly courts

An Oklahoma man has filed a denture adhesive cream mass tort claim in the Philadelphia Court of Common Pleas, alleging that his use of the product caused him physical harm.

Philadelphia attorney Lee B. Balefsky, of the firm Kline & Specter, filed the personal injury lawsuit on behalf of Frank Sweat, Jr. of Calera, Okla. Sweat’s wife, Helen Sweat, is named as a co-plaintiff.

The lawsuit was filed in the form of a short-form complaint in the master denture adhesive cream docket, and as such, seeks damages as outlined in the master litigation.

According to the complaint, Frank Sweat used SuperPoligrip from about 2000 to 2009. He alleges that his use of the product lead to him suffering neuropathy, myelopathy, hyperzincuria, zinc toxicity, extensive nerve damage, hypocupremia, numbness, severe pain, tingling, tremors, crams, muscle twitch, paralysis, inability to walk, loss of balance, difficulty breathing, liver failure, kidney failure, bone marrow depletion, other neurological disorders and pain and suffering.

The plaintiff also claims that he suffered severe emotional distress, depression, anxiety, worry and anguish as a result of his use of the product.

The defendants named in the lawsuit are Smithkline Beecham Corporation, Glaxosmithkline Consumer Healthcare LLC, and Block Drug Company.

The lawsuit accuses the defendants of negligence, strict liability-design defect, strict liability-failure to warn, breach of implied warranties, violation of Pennsylvania’s Consumer Protection Act, common law fraud, gross negligence and malice, and loss of consortium.

A jury trial has been demanded.
