Harrah's Chester Casino hit with premises liability complaint

A Chester, Pa. man who alleges he sustained injuries after falling inside a casino-operated parking lot is suing the gambling hall and its parent company in Philadelphia Common Pleas Court.

Philadelphia attorney Scott E. Diamond, of the city firm Clearfield, Kofsky & Penneys, filed the premises liability lawsuit July 29 on behalf of client Booker T. Wilson.

The defendants named in the complaint are Chester Downs & Marina Inc. c/o Harrah’s Entertainment, Harrah’s Chester, Caesars Entertainment, and Harrah’s Chester Casino & Racetrack.

According to the lawsuit, Wilson was a business invitee of the casino, located at 777 Harrah’s Boulevard, back on Dec. 22, 2009, when, while traversing the exterior of the property, he slipped on a patch of untreated ice.

As a result of his fall to the ground, Wilson suffered a ligament tear in his knee requiring surgery, and creating permanent scarring, in addition to other, unspecified ills and injuries, the lawsuit states.

His injuries required Wilson to spend various sums of money on medical care and treatment, the suit claims.

The complaint accuses the defendants of carelessness and negligence for allowing a dangerous and defective condition to exist on their premises, failing to warn casino visitors of the hazardous condition, failing to inspect the parking lot and walkway, and being “otherwise careless, reckless and negligent.”

In addition to his physical injuries, Wilson has suffered mental impairment, which, together with his physical problems, has prevented him from carrying out his usual duties and activities, the lawsuit alleges.

Wilson demands judgment against the defendants, jointly and/or severally, in an amount in excess of $50,000, plus interest and related court costs.

The plaintiff has demanded a jury trial.
