A motorcyclist from Montgomery County, Pa. who claims he sustained serious bodily injuries after being struck by another driver is suing the couple who owns the other vehicle involved in the accident.
Philadelphia attorney Michael O. Pansini, of the law firm of Pansini & Mezrow, filed the personal injury complaint Aug. 31 at the Philadelphia Court of Common Pleas on behalf of Christopher Clayboss of Eagleville.
The defendants named in the lawsuit are Ellen and Joseph Duggan of Hatfield, Pa.
According to his civil claim, Clayboss was riding his motorcycle down South Broad Street near the intersection with Hancock Street in Lansdale, Pa. last year, when he was suddenly struck by a vehicle owned and operated by the defendants.
The accident caused Clayboss to suffer a host of physical injuries, including, but not limited to, numerous injuries to his shoulder and back, as well as an aggravation of pre-existing physical conditions, the lawsuit states. He has also suffered mental anguish and humiliation as a result of the accident.
Clayboss, the suit states, has had to spend large amounts of money on medical care and has been unable to attend to his regular duties and activities because of his injuries.
The complaint accuses the defendants of carelessness, recklessness and negligence for making an inappropriate and dangerous left hand turn under the circumstances, operating a motor vehicle in a reckless manner, and violating various state motor vehicle codes.
Clayboss demands judgment against the defendants in a sum in excess of $50,000, plus delay damages, punitive damages, interest and related costs.
A jury trial has been demanded.
