North Jersey woman files Yaz lawsuit in state court in Philadelphia

A 31-year-old North Jersey resident has filed a mass tort claim against the makers of the birth control drug Yaz, alleging the product caused her to sustain serious bodily injury.

Philadelphia attorneys Sol H. Weiss and Gregory S. Spizer filed the short-form complaint in the Yaz, Yasmin, Ocella, Gianvi master docket Sept. 13 at the Philadelphia Court of Common Pleas on behalf of North Bergen, N.J. resident Sarah Michel.

The defendants named in the lawsuit are the Bayer Corporation, Bayer Healthcare, LLC, Bayer Pharmaceuticals Corporation, Bayer Healthcare Pharmaceuticals, Inc., Berlex Laboratories, Inc., Berlex, Inc., and Bayer Pharma AG.

According to the civil claim, Michel was diagnosed with a pulmonary embolism on or about Sept. 21, 2009, a disease she claims was the direct result of her ingesting Yaz from approximately April 2009 to September 2009.

The lawsuit contains counts of strict liability, fraudulent concealment, breach of implied warranty of merchantability and breach of implied warranty of fitness for a particular purpose, negligent failure to warn, negligent design defect, negligent misrepresentation, breach of express warranty, fraud, general negligence and violations of consumer protection laws.

The plaintiff seeks relief as set forth in the master Yaz, Yasmin, Ocella, Gianvi litigation at Philadelphia’s Common Pleas Court.

A jury trial is being demanded.
