A Lansdale, Pa. woman who claims she sustained a whole host of physical injuries after she was thrown from her motorcycle after driving over an un-level manhole cover has filed a personal injury claim against the company responsible for paving the roadway.
Philadelphia attorneys Fredric S. Eisenberg and Daniel J. Sherry, Jr., of the firm Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck, filed the civil suit Feb. 21 at Philadelphia’s Court of Common Pleas on behalf of Barbara Bond.
The defendant named in the civil action is Blue Bell, Pa.-based Highway Materials Inc.
According to the complaint, Bond was operating her motorcycle eastbound on Orvilla Road in Montgomery County, Pa. back on April 24, 2011, when she encountered an uneven milled surface in her lane of travel.
Bond ended up losing control of her bike after she encountered the un-milled manhole cover, at which time she was thrown from the motorcycle and onto the ground, the lawsuit states.
Bond sustained various “disabling and disfiguring” injuries, including leg fractures, hip and torso injuries, shoulder injuries and other ills.
She also sustained “emotional upset, anxiety and other physiological, psychological and functional disturbances,” the complaint alleges.
As a result of the accident, Bond has had to undergo medical and surgical care, and has incurred numerous expenses related to her medications and hospital care.
Bond has also suffered mental anguish, humiliation, embarrassment and loss of well-being as a result of the accident, the suit claims.
The lawsuit accuses the defendant of negligence for failing to adequately monitor the roadway, failing to timely and reasonably repair and/or correct the dangerous roadway conditions, failing to erect warning signs, failing to direct traffic around the problem areas on the roadway, increasing the risk of harm to plaintiff and being generally negligent.
Bond demands judgment against the defendants in excess of $50,000.
A jury trial has been demanded.
