A Texas man is suing a host of drug manufacturers in Pennsylvania state court over injuries he allegedly sustained as a result of taking the drug Risperdal, which is an antipsychotic drug used to treat disorders such as schizophrenia.
Jamie L. Sheller and Brian J. McCormick, as well as lawyers with the Thomas J. Henry Injury Attorneys firm in Corpus Christi, TX, jointly filed the mass tort civil action April 19 at Philadelphia’s Court of Common Pleas on behalf of Lone Star State resident Joshua Fontaine.
The lawsuit, which was filed as an abbreviated individual complaint in the master Risperdal litigation at the Philadelphia courthouse, alleges that Fontaine, who resides in Willis, Texas, was diagnosed with gynecomastia as a result of having ingested the drug from 2003 to 2011.
Gynecomastia is the abnormal development of large mammary glands in males that leads to breast enlargement.
Fontaine also claims he suffered economic losses and put on weight as a result of taking Risperdal.
The defendants in the lawsuit include Ortho-McNeil-Janssen Pharmaceuticals, Johnson & Johnson Company, Excerpta Medica Inc. and Elsevier Inc.
The complaint accuses the defendants of negligence, fraud, strict product liability, breach of express and implied warranties, unfair and deceptive trade practices and conspiracy.
Fontaine claims he has incurred medical expenses relating to the treatment of his injuries.
The plaintiff seeks unspecified compensatory and punitive damages as well as damages relating to loss of consortium on the part of the plaintiff’s spouse.
