Pa. women and out-of-state plaintiff file Yaz mass tort claims in Phila. court

Two Pennsylvania women and an out-of-state plaintiff filed separate Yaz mass tort claims at Philadelphia’s Common Pleas Court earlier this week.

Attorneys Sol H. Weiss and Gregory S. Spizer filed the first complaint on behalf of East Haven, Conn. resident Cathryn Argyros, who used the birth control drug Yaz from early 2007 until the spring of 2010.

On May 8, 2010, the day she stopped using the drug, the suit states, Argyros, 27, was diagnosed with deep vein thrombosis, which is a blood clot formation.

The second lawsuit was also filed by attorneys Weiss and Spizer, this one on behalf of Johnstown, Pa. resident Natalie Ramos, a 39-year-old who also blames the birth control drug for her diagnosis of deep vein thrombosis in May 2010.

The Ramos complaint states the woman took Yaz from early January 2008 until May 10, 2010, the day her injuries were discovered.

Ramos also ingested Yasmin from approximately Sept. 27, 2004 to December 19, 2006.

The third complaint was filed by Plymouth Meeting, Pa. attorney Gary S. Auerbach on behalf of Sarah Washco of Folcroft, Delaware County.

Washco, 36, was prescribed the birth control drug Ocella from early January 2009 until May 1, 2010.

The Washco suit claims that the plaintiff developed pulmonary emboli in both lungs as a result of her taking the drug; the diagnosis was made on May 1, 2010.

The defendants named in the Argyros and Ramos lawsuits are Bayer Corporation, Bayer Healthcare LLC, Bayer Pharmaceuticals Corporation, Bayer Healthcare Pharmaceuticals Inc., Berlex Laboratories Inc., Berlex Inc. and Bayer Pharma AG.

The Washco lawsuit lists the above-mentioned defendants in addition to Teva Pharmaceutical Industries LTD, Teva Pharmaceuticals USA, Barr Pharmaceuticals Inc., Barr Pharmaceuticals LLC and Barr Laboratories Inc.

All three lawsuits accuse the defendants of fraudulent concealment, strict liability, breach of implied warranty of merchantability and of fitness for a particular purpose, negligent failure to warn, negligent design defect, negligence, negligent misrepresentation, breach of express warranty, fraud and violations of consumer protection laws.

All three suits were filed as short-form complaints in the master Yaz, Yasmin, Ocella, Gianvi Litigation at Philadelphia’s Common Pleas Court.

The three women, all of who demand jury trials, seek damages as set forth in the master litigation.
