Northeast Phila. couple and Florida residents file asbestos mass tort claims in Pa. court

Two more asbestos personal injury claims were filed at Philadelphia’s Common Pleas Court late last week, one on behalf of a Philadelphia couple and the other by husband and wife plaintiffs who reside in the Sunshine State.

The first lawsuit was filed May 9 by Philadelphia attorney Benjamin P. Shein on behalf of Sheldon and Roslyn Feldman of Northeast Philadelphia.

According to the complaint, Sheldon Feldman was told by doctors at Jeanes Hospital in the Fox Chase section of the city that he had malignant mesothelioma, a disease the male plaintiff claims he got as a result of his having been exposed to asbestos-containing products throughout the years.

The lawsuit states that Feldman had worked as a plasterer and paperhanger all throughout the Philadelphia region from the 1940s until the late 1960s.

The mass tort claim alleges that Feldman was exposed to asbestos fibers during this time in his life.

The defendants listed in the lawsuit are Basic Inc., Certain-Teed Corporation, DAP Products Inc., Georgia-Pacific Corporation, Kaiser Gypsum Company, Kentile Floors, Owens-Illinois Inc., Pfizer Inc. and Union Carbide Corporation.

The second mass tort claim was filed May 10 by Philadelphia attorney Steven J. Cooperstein on behalf of Leroy and Katherine Kilmer of Winter Haven, FL.

The suit, which, like the Feldman claim, was filed as a short-form complaint in the master asbestos litigation at Philadelphia’s Common Pleas Court, claims that Leroy Kilmer, 67, was first diagnosed with asbestosis in July 2011, and then diagnosed with full-blown lung cancer the following month.

The plaintiffs blame Kilmer’s exposure to asbestos-containing products during his working years on his disease.

The lawsuit states that Kilmer, who also smoked between one and two packs of cigarettes a day from 1962 to 2011, worked as an electronic technician from the early 1960s to the late 1960s, in plant maintenance from 1968 to 1969, as an electrician from 1969 to 1970 and as a production plant superintendent from 1970 to 1986.

The suit claims that Kilmer was exposed to asbestos fibers during his various jobs throughout the years.

There are many defendants listed in the lawsuit. They include, but are not limited to, Allied Signal Inc., Bayer CropScience Inc., DAP Inc., Foster Wheeler Corp., Georgia-Pacific LLC, John Crane Inc., Owens-Illinois Inc., Rockbestos Co., Siemens Energy & Automation Inc., Union Carbide Corp., and CBS Corp.

The plaintiffs in both lawsuits seek damages as set forth in the master asbestos litigation at Philadelphia’s Common Pleas Court.
