Phila. mesothelioma victim files mass tort asbestos claim

An 88-year-old Philadelphia man who was diagnosed early last year with mesothelioma, a disease he attributes to asbestos exposure, is suing a number of companies that deal in asbestos-containing products.

Maryanne Browning is suing in her position as executrix for the estate of Walter Zimmerman, a Northeast Philadelphia man who claims his lung cancer diagnosis was the result of his working around asbestos-containing products during his years as a machinist and renovator for various companies.

Zimmerman, the short-form complaint shows, worked for Ambler, Pa.-based Keasbey & Mattison, as well as for Philadelphia-based Crown Cork & Seal Co., Full Gospel Church, Philadelphia Naval and Thyssendrupp Budd.

Zimmerman received his mesothelioma diagnosis in January 2011 at Abington Memorial Hospital, the mass tort claim states.

The suit says Zimmerman never smoked a day in his life.

The following companies are named as defendants in the civil action: 84 Lumber Co., Beazer East Inc., CBS Corp., Certainteed Corp., Chevron USA Inc., Dana Companies LLC, DAP Inc., Ford Motor Co., General Electric Co., Genuine Parts Co., Georgia Pacific LLC, Honeywell International Inc., Ingersoll-Rand Co., Kaiser Gypsum Co. Inc., Maremont Corp., Owens-Illinois Inc., Pep Boys, Pneumo Abex LLC, Rapid-American Corp., Sears Roebuck and Co., U.S. Rubber Co., Yarway Corp. and Trane U.S. Inc.

The lawsuit seeks damages as set forth in the master asbestos litigation at Philadelphia’s Common Pleas Court.

The complaint was filed by Cherry Hill, N.J. attorney Neidra Wilson of the firm Weitz & Luxenberg.
