A Home Depot customer who alleges she became injured after a chair on which she was
sitting on in the South Philadelphia store collapsed under her has filed a personal injury claim against the home improvement retailer.
Philadelphia attorney David E. Kwartler filed the civil action Aug. 17 at the Philadelphia Court of Common Pleas on behalf of city resident Shelly Perkins.
The defendants named in the suit are the Home Depot store at 2200 W. Oregon Avenue, The Home Depot Inc. and Home Depot U.S.A. Inc.
The complaint alleges that Perkins sustained a variety of injuries back on Aug. 20, 2010, when a chair on which she was sitting at the retail store suddenly broke and collapsed, sending her crashing to the floor.
As a result of the incident, Perkins sustained cervical strain and sprain, lumbar strain and sprain, bilateral knee strain and sprain, a shock to her nervous system and other ills and injuries.
Perkins has been forced to expend large amounts of money on medical attention, hospitalizations, and rehabilitative care.
Perkins has suffered earnings losses because of her inability to work and she has been prevented from attending to her daily activities and duties.
The lawsuit accuses the defendants of negligence for creating or permitting the existence of an unsafe and hazardous condition, failing to adequately inspect the chair, failing to warn the plaintiff of the dangerous condition and failing to use due care under the circumstances.
For each of the three counts listed in the complaint, Perkins seeks $50,000 in compensatory damages, together with interest and costs.
An arbitration hearing has been scheduled for late April 2013.
