A Philadelphia man who claims he sustained a rotator cuff tear and other injuries after a garage door at his place of employment fell on top of him last year has initiated a products liability complaint against the makers of the device.
Nicholas Camacho alleges in his civil action that he was injured back on March 29, 2011, at about 9:30 in the morning when, during the course of his employment at Durham School Services in Philadelphia, a portion of a garage door collapsed on top of Camacho and knocked him to the ground.
The incident caused Camacho to sustain a torn left rotator cuff that required surgery, as well as a left foot fracture, left trapezius myofascitis, cervical disc injuries and other injuries to his bones, muscles, tendons, ligaments, nerves and tissues, the lawsuit states.
The complaint was filed Nov. 13 at the Philadelphia Court of Common Pleas by lawyers with Philadelphia-based Jeffrey R. Lessin & Associates.
Nicholas Camacho and his wife, Wanda, are named as the plaintiffs in the case, while the named defendants are Ace Overhead Door Company Inc. and BBK Industries LLC.
The complaint accuses the defendants of negligence for failing to properly and adequately design the garage door in question, failing to properly assemble and install the device and disregarding the rights and safety of the plaintiff.
Nicholas Camacho’s finances have been affected due to his inability to work because of the incident, and his injuries have also caused him and his wife to spend various sums of money on medical attention and treatment, the lawsuit alleges.
In addition to the strict liability count, there is also a claim for loss of consortium filed on behalf of Wanda Comacho, who asserts her relationship with her husband has been negatively affected because of his circumstances.
The plaintiffs seek judgment in excess of $50,000, plus delay damages, costs and other court relief.
