Patient who sustained fractures during treatment sues Phila. rehab center

A former patient at a Philadelphia rehabilitation clinic last week filed suit against agency over claims that she sustained serious injuries after she fell while in the care of a center employee.

Elois Greene is suing Penn Center for Rehabilitation and Penn Medicine over allegations that she sustained lower extremity fractures after she fell to the ground at the rehab center, located at 3609 Chestnut St., back on March 2 of this year.

Center employees had the plaintiff stand up on her own at the time, although Greene informed the employees that she was unable to do so.

“Defendant’s employees knew or should have known that the Plaintiff could not stand on her own,” the lawsuit states. “If standing on her own was appropriate, the Defendant’s employees should have been on guard and ready and able to stop Plaintiff from falling while standing. There should have been a railing or something for Plaintiff to hold as needed.”

The complaint accuses the defendants of negligence for failing to properly train and/or test employees, negligent hiring, having Greene stand on her own when they knew or should have known that this would be dangerous for the plaintiff, not properly monitoring or supervising Greene, and inadequate staffing.

Greene ended up suffering from unspecified injuries to her lower extremities, fractures, de-conditioning, aggravation of other medical problems, trauma, restrictions on range of motion and function, pain and suffering and other ills.

Greene has also allegedly sustained embarrassment and humiliation, loss of ability to enjoy life’s pleasures and disfigurement.

The plaintiff has also incurred past medical expenses relating to the treatment of her injuries and she expects to incur future medical expenses as well.

Greene seeks more than $50,000 in compensatory damages, in addition to interest, costs and delay damages.

The plaintiff is being represented by Philadelphia attorney Val Pleet Wilson, of the firm Wilson and Johnson, who filed suit on Greene’s behalf on Nov. 13 at state court in Philadelphia.
