A Philadelphia woman shopping in a clothing store seeks damages for injuries she sustained
when a rack fell on top of her, according to a personal injury suit filed in the Philadelphia Court of Common Pleas.
Sharon Booth, of the 5000 block of N. Marvine Street, was browsing at the Ten Spot, located on Olney Ave. in Philadelphia, on Aug. 17, 2012. A metal rack holding clothing suddenly detached from the wall and struck Booth, the complaint says.
As a result of the incident, Booth sustained injuries to her neck, back, head, muscles and tendons, as well as experiencing a shock to her system and enduring ongoing pain and humiliation, according to the complaint.
The complaint says that the recovery from her injuries has forced Booth to pay for mounting medical expenses, while at the same time finding it more difficult to perform her daily routines and duties, denying her the ability to make an adequate income.
Booth says that the injuries are a result of the store employees' negligence, including their failure to maintain and secure the metal rack and their inability to direct foot traffic away from the aisle with the defective rack.
The plaintiff is represented by Philadelphia attorney Donald Manchel.
