PITTSBURGH - A Butler resident has brought allegations against a St. Louis-based debt collection company for unlawful debt collection practices.
Chris Davison has filed a lawsuit June 26 in the U.S. District for the Western District of Pennsylvania against Medicredit Inc., citing violation of the Fair Debt Collections Practices Act.
According to the complaint, beginning prior to December, the defendant repeatedly contacted Davison on his cellphone in an effort to collect payment for a medical bill alleged to be incurred for personal, family or household purposes.
Davison claims he told the defendant that he disputed the debt in question as he thought it would be paid by his health insurance and told the defendant to stop calling him during the workday because it was inconvenient. In the lawsuit, Davison also asserts that he never received any written correspondence to validate the alleged debt or inform him of his right to dispute it
The suit states that the defendant continued to call Davison on his cell during the workday and even warned him that if he didn't make a payment the debt would appear on his credit report, which caused Davison stress and anxiety as he felt pressured to pay a debt he believed he didn't owe.
Alleging that the defendant's actions were made with the intent to harass, deceived and coerce him, Davison seeks actual and statutory damages, attorney and witness fees, court costs, and other relief deemed appropriate by the court.
