A Pennsylvania dental products manufacturer is suing a Wisconsin dental products manufacturer, alleging patent infringement.

Dentsply International Inc., with its principal place of business in York,  filed a lawsuit Sept. 1 in U.S. District Court for the Middle District of Pennsylvania against American Orthodontics Corp. of Sheboygan, Wis., alleging patent infringement.

According to the complaint, on Aug. 21, 2001, Dentsply lawfully patented the '930 patent, "Orthodontic Aid," issued by the U.S. Patent and Trademark Office.

The suit says American Orthodontics, which is not authorized to make or sell any product that falls within the claims of the '930 patent, has manufactured, used and sold orthodontic brackets, under the trademark EMPOWER, bearing indicia that infringe at least claim 1 of the '930 patent.

Dentsply seeks compensatory damages, enhanced damages of three times the amount of actual damages, plus attorney fees and court costs. It is represented by attorneys Shawn K. Leppo and Harvey Freedenberg of McNees Wallace & Nurick in Harrisburg.
