Plaintiff counsel wants alternative service for accident complaint

PHILADELPHIA – Plaintiffs attorneys are seeking alternative service of their complaint to a defendant they have been unable to locate.

On Sept. 11, Samuel Fishman filed a motion for alternative service with respect to defendant Clyde Drummond, at his last known address on Sheldon Street in Philadelphia.

Investigation and searches through TransUnion/TLO, WhitePages.Com and the United States Postal Service confirmed Drummond lived at the Sheldon Street address as of Aug. 25. Therefore, Fishman’s motion seeks physical posting of the complaint, first-class delivery and certified mail services at the residence. 

A hearing in this matter was set for this past Friday at Philadelphia City Hall, in Court chambers.

On Jan. 6, 2014, plaintiff Ronald McClendon was driving a 1996 Infiniti with fellow plaintiff Wanda Bethea as a passenger, traveling on Germantown Avenue near Wister Street in Philadelphia.

At the same place and time, defendant Gregg Alston owned and operated a 1996 Chevrolet, while Drummond owned and operated a Dodge Ram. The suit alleges negligent driving on the parts of both Alston and Drummond subsequently led to a serious car crash.

McClendon suffered cervical strain and sprain, shoulder strain and sprain, myospasm, myofascitis, other injuries and severe nervous system shock. Bethea suffered cervical strain and sprain, lumbar strain and sprain, headaches, cephalgia, myospasm, myofascitis and other injuries.

The plaintiffs are each seeking judgment not in excess of $50,000 from all defendants in this case.

The plaintiffs are represented by Samuel Fishman in Philadelphia.

The defendants are represented by Damaris L. Garcia of Snyder Barrett & Wilkinson, plus Raymond W. Ruthrauff, both also in Philadelphia.
