Beneficiaries sue trustees for $400K in allegedly unpaid settlement funds

A Pittsburgh woman and a Washington, D.C., man have filed a lawsuit to claim settlement funds from a revocable trust.

Elisabeth Rabner and Brian Kaplan filed suit in U.S. District Court for the Western District of Pennsylvania on Oct. 8 against William Titleman of Palm Beach, Fla., and Fred Kaplan of Beverly Hills, Calif., citing breach of contract.

According to the complaint, Titleman and Fred Kaplan are trustees and powers of attorney for the Joan Kaplan Revocable Trust and that the plaintiffs are beneficiaries of that trust.

The parties allegedly consented to settle any claims that Rabner and Brian Kaplan had in regards to the trust and award them $200,000 each. The complaint states that settlement proceeds have not been paid.

The plaintiffs seek $400,000 in actual damages, plus attorney fees, costs, interest and punitive damages. They are represented by Fred G. Rabner of the Rabner Law Offices of Pittsburgh.
