Amtrak sues truck driver over alleged negligence in semi-bridge collision

A transportation company is suing an East Earl man over damages he caused when he drove his tractor-trailer into a bridge, claiming the damages are the fault of the driver's negligence.

National Railroad Passenger Corp., also known as Amtrak, filed a complaint Oct. 8 in the U.S. District Court for the Eastern District of Pennsylvania against John Hurst, alleging negligence.

On Oct. 31, 2013, the complaint states, Hurst drove his tractor-trailer into an Amtrak-owned bridge in Malvern.

The complaint states Hurst was negligent in that the bridge was appropriately posted with a height restriction of 8 feet, 6 inches, but Hurst's truck was approximately 9 feet, 5 inches high. As a result, the collision caused substantial damage to the bridge.

Amtrak seeks a judgment of no less than $75,000, plus costs of the suit. Amtrak is represented by Richard K. Hohn of Hohn & Scheuerle in Philadelphia.
