Copyright

PHILADELPHIA-A commercial artist recently filed suit against Dr. Hoy and Power Promotions, the makers of MMA Elite pain remedies for their failure to pay him for his work on the project.

On Oct. 20, John Dallaire filed suit in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they committed copyright infringement when they failed to include him in the proceeds from the sale of the defendants' product.

The defendants hired the plaintiff to design its pain relief remedy packaging. The plaintiff alleges the defendants told him the project was dead when in fact it was being sold by retailers such as Wal-Mart.

The plaintiff is seeking payment under his contract, plus damages, attorney fees, liquidated damages and costs of litigation. He is represented by Chad A. Rutkowski of Philadelphia, Pennsylvania.

U.S. District Court for the Eastern District of Pennsylvania case no. 15 cv 05705.
