PITTSBURGH -- A worker at a Washington County, Pennsylvania oil and drilling company recently filed a class-action suit alleging the business is failing to properly compensate its employees for overtime worked.
Seth Baughman, on behalf of others, filed the lawsuit against Killion & Sons Well Service, Inc. on Sept. 1 in the U.S. District Court for the Western District of Pennsylvania citing a violation of the federal Fair Labor Standards act and the Pennsylvania Minimum Wage Act.
Baughman and approximately 70 other workers are assigned to gas and oil drilling sites in Pennsylvania and surrounding areas. They are paid on a two-week, 14-day basis with the work week beginning on Sunday and ending on Saturday. Baughman said the workers consistently work nine consecutive days of 12-hour shifts before receiving three days off. Based on this, he alleges the employees work more than 40 hours a week and are entitled to overtime pay.
Baughman, who is seeking damages and all costs related to the case, is represented by Pittsburgh-based attorneys James Brink of Brink Law Offices, LLC and Steven C. Townsend of Eddy DeLuca, Gravina & Townsend.
