PHILADELPHIA -- A Napa Valley, California winery has filed a lawsuit seeking to stop a Doylestown, Pennsylvania winery from operating under a similar name.
Alpha Omega Winery, LLC. filed suit in the U.S. District Court for the Eastern District of Pennsylvania on Oct. 19, alleging the defendant's Alfa & Omega Winery brand name was too similar to that of the plaintiff who has been doing business using its name since 2006. The plaintiff alleges the defendant's use of its name violates federal copyright laws.
The plaintiff argues that the similarity in the names is likely to cause confusion or mistakes, and has caused damage to its reputation. A demand for defendants to cease and desist has not been complied with.
The plaintiff is seeking damages, costs and attorney fees. The plaintiff is represented by Barry L. Cohen of Conshohocken, Pennsylvania.
