Laboratory Corp. of America seeks to have lawsuit moved to U.S. District Court

Laboratory Corp. of America filed a motion on Oct. 21 to have its lawsuit with Brandy L. Apicella and Michael A. Apicella be moved to the U.S. District Court for the Western District of Pennsylvania.

On or about Sept. 22, Brandy L. Apicella and Michael A. Apicella filed a complaint against Laboratory Corp. of America, also known as LabCorp or Laboratory Corp. of America Holdings, in the Court of Common Pleas of Alleghany County. LabCorp is a corporation under the laws of state of Delaware, with its principal place of business in North Carolina.

In support of their motion, LabCorp claims that numerous cases from the Commonwealth of Pennsylvania reveal that potential awards based on conditions similar to those alleged by the Apicellas exceed the $75,000 jurisdictional amount.

In her lawsuit against LabCorp, Brandy L. Apicella claimed that she suffered severe and serious injuries all and/or some of which were permanent in nature, which included loss of range of motion of her right arm, loss of dexterity of her right hand, and generalized pain to her right arm and hand.

LabCorp is represented by Tiffany M. Alexander and Erin W. Grewe.
