A West Grove man has filed a class action lawsuit against his former employer alleging unfair pay standards, and violation of federal and state laws.

Joseph L. Brackin, in representation of numerous fellow employees, filed a class action complaint on Sept. 2 in the U.S. District Court for the Eastern District of Pennsylvania against American Air Liquide Holdings, Inc., alleging violations of the Fair Labor Standards Act, Pennsylvania Wage Payment and Collection Law and the Pennsylvania Minimum Wage Act.

Brackin alleges that during his time of employment for American Air Liquide Holdings, he was the only on-call field service technician employed by the defendant. While employed, Brackin was continually called in to complete after-hour and overtime jobs. Brackin purports that the constant demands from the defendant caused the plaintiff to suffer intense stress, stating the job stress as a factor in his divorce from his wife. Brackin is suing the defendant, claiming that the company was in violation of a number of labor laws and in demanding him to be on call.

Brackin is seeking monetary compensation of an unspecified amount for all emotional and legal anguish. He is represented by Christopher J. Delgaizo of Kraemer Manes and Associates, LLC in King of Prussia.
