PHILADELPHIA – Individuals are suing a fantasy sports league alleging negligence, fraud and misrepresentation.

Antonio Cantamaglia and Emilio Olivia filed a class action lawsuit on Nov. 10 in the U.S. District Court for the Eastern District of Pennsylvania against DraftKings Inc., and FanDuel Inc., alleging negligence, fraudulent misrepresentation, violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, civil conspiracy, tortious interference, aiding and abetting, unjust enrichment and breach of contract.

The plaintiffs claim that during 2014 and 2015 while taking part in competitions from the two companies, the competitors, Cantamaglia and Olivia, were unfairly cheated out of funds. Although the defendants claimed to offer fair and competitive opportunities to win money through fantasy sports leagues, the companies actually rigged the systems by allowing executives and employees to infiltrate the supposedly secure system, the complaint states. The plaintiffs are suing the defendant on claims of fraud and misrepresentation for such unethical practices.

The plaintiffs are seeking monetary relief for all personal damages suffered, as well as all legal fees. Cantamaglia and Olivia are represented by Joseph G. Sauder, Matthew D. Schelkopf and Andrew W. Ferich of Chimicles and Tikellis in Haverford; Richard D. McCune, David C. Wright and Daniel H. Chang in Redlands, California; and Thomas B. Malone of the Malone Law Firm in Philadelphia.
