Lehigh County couple sue J.C. Penney over trip and fall at area mall

PHILADELPHIA – A Lehigh County couple is suing J.C. Penney over an injury suffered during a trip and fall at their Lehigh Valley mall store, which injured her right knee.

Kimberly Bult and Keith Bult filed a lawsuit against the J.C. Penney Corp. on Nov. 2 in the U.S. District Court for the Eastern District of Pennsylvania, citing negligence and loss of consortium.

According to the complaint, Kimberly Bult entered the store on Dec. 15, 2014, and walked into the department that sells carpeting. Bult claims that she tripped on a rug that was sticking out onto the walkway path, jutting out of a display in the store’s home department, and severely damaged her right knee.

She also claims that J.C. Penney contained inadequate warning for her and others to walk safely. She claims that the injuries she suffered during the fall are permanent and will cause her to suffer a loss of life’s pleasures and companionships.

The Bults are represented by Allentown-based attorney Richard J. Orloski.
