SCRANTON – A Clinton County couple is claiming negligence after a fall in a Walmart women’s dressing room.

Patricia A. Sheetz and Richard H. Sheetz filed a lawsuit on Nov. 18 against Wal-Mart Stores Inc. and Wal-Mart Stores East Inc. in the U.S. District Court for the Middle District of Pennsylvania alleging negligence.

According to the complaint, on Dec. 12, 2013, Patricia A. Sheetz was inside a women’s dressing room a Walmart Supercenter where a bench was placed in a location, she claims, that could not been seen and there was no warning of the existence of the bench and its location. As a result, she fell over the bench and suffered serious and permanent injuries, according to the lawsuit, to head, body and limbs -- specifically a fracture to her left hip.

The plaintiffs claim that Wal-Mart was negligent in allowing a bench in the walkway and changing area of a women’s dressing room without providing adequate room to walk or turn into an aisle, which led to her subsequent fall.

She is seeking a judgment for more than $75,000, plus interest and costs. The Sheetz are represented by Lee H. Roberts of Lock Haven.
