PHILADELPHIA – Employees are suing the bakery that employed them, alleging that they were not paid for overtime.

Matthew Carr, Terry Carr, David Tumblin and Gregory Brown filed a class-action complaint Dec. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Flower Foods Inc., and Flowers Baking Co. alleging violations of the Fair Labor Standards Act and Pennsylvania and Maryland wage laws and unjust enrichment.

According to the complaint, the plaintiffs were each employed by Flower Foods, a bakery company and food distributor, and during their time of employment they regularly worked anywhere from 40 to 60 hours per week. Despite the hours worked, and regularly exceeding a normal full-time schedule, the employees were not compensated for their time, the complaint states.

The plaintiffs are seeking compensation for all damages, back pay and legal fees. They are represented by Charles E. Schaffer of Levin Fishbein, Sedran and Berman in Philadelphia; Shawn J. Wanta, Patricia A. Bloodgood and Christopher D. Jozwiak of Baillon Thome Jozwiak and Wanta of Minneapolis; and Susan E. Ellingstad and Rachel A.
