PITTSBURGH – A former employee is suing Walmart alleging racial discrimination in the workplace.

Spencer filed a complaint on Dec. 10 in the U.S. District Court for the Western District of Pennsylvania against Wal-Mart Stores East LLP, alleging racial discrimination, retaliation and failure to uphold Americans with Disabilities Act regulations.

Spencer, an African-American, was hired in November 2013 and during his employment worked as a cashier, forklift operator and maintenance worker, the complaint states. In September 2014, the plaintiff says he requested extra training and some assistance in a specific operation, as he suffered with learning disabilities, depression and several other disabilities. Upon this request, he was denied the accommodations in an allegedly disrespectful way. Two months later, Spencer was terminated after he was accused of starting a fight, the complaint states. He is suing Wal-Mart for discrimination against his ethnicity, as well as violation of ADA.

Spencer is seeking compensation of an unspecified amount to cover all damages and legal fees. He is represented by Ari R. Karpf of Karpf, Karpf & Cerutti PC in Bensalem.
