PHILADELPHIA – A Quakertown woman is suing her insurance provider alleging that her denial of benefits was unlawful.

Denise Kemmerling filed a complaint on Dec. 9 in the U.S. District Court for the Eastern District of Pennsylvania against The Prudential Insurance Co. of America.

According to the complaint, Kemmerling had an insurance policy with the defendant and was eligible to be the recipient of benefits under the company's long-term disability plan. Kemmerling suffers from dermatomyositis and in 2012 her condition became more severe, causing her to leave work and apply for disability benefits, the complaint states. The defendant allegedly has denied her long-term disability claim and appeals, although the complaint states she qualified for Social Security disability benefits.

Kemmerling is seeking compensation for her lost benefits, as well as other damages and legal fees. She is represented by Marc H. Snyder of Rosen, Moss, Snyder and Bleefeld LLP in Wilmington.
