PHILADELPHIA – Two men are suing their employer after they claim they consistently worked overtime without receiving the appropriate pay for their time.

Jeffrey Miller and Teodoro Vinhar filed a class-action lawsuit Dec. 21 in the U.S. District Court for the Eastern District of Pennsylvania against Star Penn Pool Service Inc. alleging a violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the men were hired under the understanding that in the event of working overtime, they would qualify for an increase in pay rate.

This pay should have been time-and-a-half for every hour worked in excess of 40, they say.

Despite the agreement and requirement that the company to pay the plaintiffs in this manner, the men were denied overtime pay, they claim.

The plaintiffs are suing the defendant for violation of the FLSA and for all of the hardships that the loss of wages have cost them.

They are seeking compensation for all lost wages, as well as legal fees. They are represented by Michael Murphy of the Murphy Law Group LLC in Philadelphia.
