Arlington Industries alleges Ply Gem infringed on patent

SCRANTON—A Scranton-based electrical and communications products developer is suing an exterior buildings products company and its subsidiaries, alleging they infringed on a patent.

Arlington Industries in Scranton filed a lawsuit Jan. 14 in the U.S. District Court for the Middle District of Pennsylvania against Ply Gem Holdings of Cary, North Carolina, Ply Gem Industries, Mastic Home Exteriors doing business as a Mastic Home Exteriors by Ply Gem, and Variform doing business as Ply Gem Siding Group and/or Variform by Ply Gem, alleging patent infringement.

According to the complaint, Arlington owns the patent called "Rainproof recessed outlet box," which the defendants make, sell, use, offer to sell, and/or import without authority from Arlington. As a result, Arlington has been and continues to be monetarily damaged, the suit says.

Arlington Industries seeks damages, interests, preliminary and permanent enjoining and restraining, attorney fees and costs of the suit. It is represented by attorneys Amanda J. Lavis and Robert J. Tribeck of Rhoads & Sinon in Harrisburg, and by attorneys Kathryn L. Clune, Ali Tehrani, and Jacob Z. Zambrzycki of Crowell & Moring in Washington, D.C., and New York City.
