PHILADELPHIA – An Upper Darby man is suing his deceased daughter's former employer over claims her co-workers sexually harassed her.

Richard Evans, as next of kin to deceased Melissa Evans, filed a lawsuit Jan. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Perpetual Pooch, trade name White Dog Cafe, and White Dog Cafe, alleging sexual harassment, hostile work environment, retaliation and negligent and intentional infliction of emotional distress.

The suit states Melissa Evans began working at the defendants' Wayne, Pennsylvania restaurant on Nov. 15, 2010.

During the course of her employment, the suit states Melissa Evans was subjected to various incidences of sexual harassment and sex discrimination, such as repeated instances of sexually suggestive remarks and unwelcome physical contact, which created a hostile work environment that caused her to cease working there.

Melissa Evans resisted and opposed the defendants' employees' sexually harassing conduct, but the defendants allegedly failed to take adequate measure to cease the harassment, the complaint states.

The plaintiff seeks compensatory and punitive damages, interests, attorney fees, and other costs of the suit, together to exceed $150,000. He is represented by attorney Timothy R. Hough of Jaffe & Hough in Philadelphia.
