WHITE PLAINS, N.Y. – Several people are suing a Pennsylvania financial services company and its subsidiary bank over claims of unpaid overtime compensation.
Yury Gokhberg, Marat Gokhberg, David Jaffe, Surekha Bassi and Marc Franchi filed a lawsuit July 30 in the U.S. District Court for the Southern District of New York against The PNC Financial Services Group and PNC Bank, alleging violations of the Fair Labor Standards Act and the New York Minimum Wage Act.
According to the suit, the plaintiffs are current and former employees of the defendants. The suit states that while the plaintiffs were employed by the defendants as mortgage loan officers, they routinely worked more than 40 hours per week.
The suit states the defendants did not pay the plaintiffs an overtime premium for hours worked more than 40 hours per week. The suit further states the plaintiffs' work days regularly exceeded 10 hours, but their compensation for these days was less than what an employee compensated at the minimum wage rate would earn for the same number of hours.
The plaintiffs seek to recover unpaid compensation, liquidated damages, interests, attorney fees, and costs of the suit. They are represented by attorneys Gregory K. McGillivary, Diana J.
