PHILADELPHIA—A Virginia man is suing Philadelphia-based Life Insurance Company of North America (LINA), claiming the insurer wrongly canceled his long-term disability benefits.

David Allen Welsh filed a lawsuit on Jan. 11 in U.S. District Court for the Eastern District of Pennsylvania against LINA, alleging breach of contract.

According to the complaint, Welsh served as a project manager for Honeywell International, where he participated in a disability policy for employees issued by LINA. Welsh claims he became disabled with chronic pain, osteoarthritis, diabetes and other conditions while covered under the policy; and as of June 21, 2013 is no longer able to work. The suit says on March 19, 2015, however, that LINA discontinued Welsh’s benefits, which they had been paying since Dec. 20, 2013. Although Welsh has appealed the decision, the case remains closed.

Welsh seeks recovery of unpaid benefits, restoration of future payments under the policy and reimbursement for legal fees. He is represented by attorney Jason A. Newfield and Justin C. Frankel of Frankel & Newfield P.C. in Garden City, New York.
