PITTSBURGH – A former employee at a Pennsylvania university is suing the institution, alleging she was fired because of age discrimination.

Patricia K. Simmons filed a lawsuit Dec. 22, against Indiana University of Pennsylvania in U.S. District Court for the Western District of Pennsylvania alleging age discrimination and a violation of the Equal Pay Act.

According to the complaint, Simmons, 64, was a development officer at the university starting February 2008 when she was fired without just cause or legal excuse Dec. 11, 2014.

Prior to her termination, the suit says, Simmons was the lowest paid but best performing employee in the development office. The lawsuit states she had raised $259,593 since July 2014, far more than any other employee, including her direct supervisor.

Simmons seeks a jury trial, reinstatement to her previous position, an adjustment of wage rates and that Indiana University destroy all derogatory comments and discipline files regarding her.  She is represented by attorney John W. Murtagh, Jr. of Murtagh, Hobaugh & Cech in Wexford.
