HARRISBURG – A Carlisle woman is seeking damages following her allegedly wrongful termination, claiming that the cause was her disability.
Jean Calaman filed a complaint Jan. 21 in the U.S. District Court for the Middle District of Pennsylvania against Carlisle Regional Medical Center and Community Health Systems Inc., alleging violation of Americans with Disabilities Act.
According to the claim, the plaintiff had been employed by the defendant for 35 years at the time of her termination. The suit says that the plaintiff suffered from tendonitis, which negatively affected her life. In July and October 2014, the plaintiff required medical leave for a surgical procedure, but in October was purportedly told that unless she found a different job within the company in 180 days, she would be terminated because she had used the 12 weeks of leave allotted by the Family and Medical Leave Act. In December 2014, following the procedure, she was terminated on Jan. 6, 2015, the suit says. She alleges she applied for other positions in the company but was never hired. She is suing the defendant for its wrongful termination in regards to her disability, the suit states.
Calaman seeks damages for front and back pay, lost wages and benefits, emotional distress, pain, suffering and legal fees. She is represented by Ari R. Karpf of Karpf, Karpf & Cerutti PC in Bensalem.
