PHILADELPHIA— A nurse is suing her employer following her termination, alleging that it was due to her medical leave.

Janice Anderson Titano filed a complaint on Jan. 27 in the U.S. District Court for the Eastern District of Pennsylvania against Trustees of the University of Pennsylvania alleging violation of the Family and Medical Leave Act.

The claim says that the plaintiff was working for the defendant in October 2013 when she sustained an injury to her left leg. A medical leave was necessary, and the plaintiff returned to work on Dec. 3, 2013. Upon returning to work, she told her supervisor she couldn't work on a scheduled day because of a post-surgery follow-up, the suit says. During a later meeting, she also informed management of additional time off she would need for  another surgery. She was suspended in January 2014 and terminated later that month, accused of working slow and diverting narcotics, the suit says.

Titano seeks damages for lost pay, benefits, as well as legal fees. She is represented by Marc E. Weinstein of Weinstein Law Firm LLC in Trevose.
