Landowner accuses Chief Gatherign of breach of contract

SCRANTON — A Luzerne County landowner is suing a Dallas-based oil and gas company, alleging breach of contract in the laying of a gas pipeline.

Henryk Strzeletz filed a lawsuit Jan. 29 in the U.S. District Court for the Middle District of Pennsylvania against Chief Gatherign LLC of Dallas, alleging breach of contract.

According to the complaint, in 2010, Strzeletz entered into a gas pipeline lease agreement with Chief Gatherign, which stated the defendant had the right to lay the piping underground on the plaintiff's land. The suit says the defendant breached the contract when it failed to place the pipeline in the location agreed upon in the contract.

The plaintiff also alleges the defendant failed to put the land back to its original state. Furthermore, the suit states, in 2012 the plaintiff returned home to find the defendant installing the pipe, without prior notice, as well as damaging trees on property.

Strzeletz seeks damages of more than $75,000 for the improper placement of the pipe, as well as the damages to the land. He is represented by attorney Edwin A. Abrahamsen Jr. of Abrahamsen, Conaboy & Abrahamsen PC in Scranton.
