Insurance firm blames McGrath Homes, Advanced Sprinkler for leak

PHILADELPHIA — An insurance company is suing two business, alleging negligence caused damage to a Warminster home.

QBE Insurance Corporation, as subrogee of Villas at Five Pounds Homeowners Association, filed a lawsuit Jan. 19 in U.S. District Court for the Eastern District of Pennsylvania against McGrath Homes of Langhorne and Advanced Sprinkler Technology of Warrington, alleging negligence and breach of warranties.

According to the complaint, in 2008 McGrath was the general contractor of the insured property at The Villas in Warminster. The suit states McGrath retained Advanced Sprinkler to install a water-supply line in the property, but on Jan. 23, 2014, an improper design or installation resulted in a water leak.

The suit says the leak resulted in sustained damage to the property and more than $150,000 in expenses. The plaintiff alleges it was the duty of the defendants to prevent such incidents from taking place.

QBE Insurance and The Villas seek more than $150,000 as well as attorney fees and other damages. They are represented by attorney Daniel J. de Luca of deLuca Levine LLC in Blue Bell.
