PITTSBURGH — A Pittsburgh woman is suing a Cleveland debt collection business, alleging violation of fair debt collection practices.
Lashay Turner filed a lawsuit June 23 in U.S. District Court for the Western District of Pennsylvania against McCarthy, Burgess & Wolff, alleging violation of debt collection practices.
According to the complaint, Turner had not incurred any debts at the time of the incident, and the alleged issues arose from a Verizon cell phone.
Between December 2014 and May 2015, the plaintiff says she was called an average of four to five times a day. Turner says she requested that the defendant e-mail instead of call about the alleged debt. The suit states the defendant continued to call at inconvenient times. In April 2014, the plaintiff alleges she again requested that the calls stop but the defendant instead threatened legal action if the debt was not paid.
Turner seeks damages for everything suffered, as well as statutory damages of $1,000 for violation of FDCPA and attorney fees, plus a jury trial. She is represented by attorney Craig Thor Kimmel of Kimmel & Silverman PC in Ambler.
