PHILADELPHIA — A former employee is suing a Philadelphia locksmith company, alleging failure to compensate overtime wages.

Shane Wolf DelReno filed a lawsuit Feb. 12 in U.S. District Court for the Eastern District of Pennsylvania against American Best Locksmith, alleging violation of the Fair Labor Standards Act (FLSA), violation of the Pennsylvania Wage Payment and Collection Law, Act of 1961, violation of Pennsylvania Common Law, and breach of contract.

According to the complaint, DelReno began working for American Best Jan. 15, 2011, as a locksmith on a daily basis, receiving 40 percent of any locksmith related fee from a regular stream of work from the defendant. The plaintiff was unable to work a full schedule as of Oct. 28, 2011, resulting from an injury received Oct. 22, 2011, and was forced to perform administrative and light duty roles subsequent to said injury, the suit says.

DelReno argues he is owed monetary compensation for work performed subsequent to the injury, which to date remains unpaid. The plaintiffs alleges he has yet to be paid for the agreed up percentage from work completed for the defendant.

DelReno seeks back and front pay, equitable relief, injunctive relief, attorney’s fees, expert fees, costs, and expenses. He is represented by attorney Marc A. Weinberg of Saffren & Weinberg in Jenkintown.
