Waitress alleges All Star Sports Bar and Grill III failed to pay proper wages

PITTSBURGH — An employee of All Star Sports Bar and Grill III is suing the restaurant, alleging it does not pay employees minimum wage or overtime compensation.

Lana Rae Blue of New Castle filed a collective action lawsuit Feb. 10 in U.S. District Court for the Western District of Pennsylvania against All Star Sports Bar and Grill III LLC in Canonsburg, alleging violations of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act, the Pennsylvania Payment and Collection Law, and unjust enrichment.

According to the complaint, Blue has been employed as a server at All Star Sports Bar and Grill III from September 2015 through the present. She alleges the defendant improperly classifies wait staff as independent contractors, instead of employees, and does not pay minimum wage or overtime compensation to the staff. The plaintiff filed the suit on behalf of herself and all others similarly situated.

Blue seeks an order permitting this litigation to proceed as a class action, prompt notice to all class members, back pay damages (unpaid overtime compensation, unpaid spread of hours’ payments, and unpaid wages), pre-judgment interest, liquidated damages, litigation costs, expenses, attorney fees, and a trial by jury. She is represented by attorney Kenneth J. Hardin II of Hardin Thompson PC in Pittsburgh.
